Louisiana Legislature Considers Constitutional Amendment to Authorize Creation of Business Court

Louisiana’s legislature is considering a constitutional amendment that could enable the creation of a business court program in the state. This month, state senator Jay Morris proposed the constitutional amendment, SB1, which would authorize the legislature to create statewide specialized courts. Currently, the legislature can only establish subject-matter courts (e.g., a drug court program) on a parishwide basis.

Senator Morris noted that the amendment would allow the legislature to form a statewide business court program and that Louisiana Governor Jeff Landry supports the amendment. The proposed constitutional amendment will need two-thirds support from both legislative chambers and then must be approved by Louisiana voters—if the legislature signs off this month, the amendment will appear on the state’s March 29 or November 15 ballot next year.
