No Covid-19 Litigation Stay
In his last few days serving in Philadelphia’s Commerce Court, Judge Gary S. Glazer issued an Order denying an insurer’s request to stay consolidated Covid-19 coverage cases. The carrier sought a stay pending appellate review of a Covid-19 coverage case now before Pennsylvania’s Superior Court. A copy of the Order in Striper LLC v. Judge Glazer states that the pending appeal in The Scranton Club v. Tuscarora Wayne Mutual Group, Inc., 238 MDA 2021 (Pa. Super. Ct.), originating in the Lackawanna County Court of Common Pleas, involves a different insurer, different insurance policy terms, and different allegations pleaded against that different insurer. Thus, an appellate decision in the Scranton Club case would not necessarily address the issues in the Philadelphia case, nor facilitate resolution of the Philadelphia litigation.
Judge Glazer Leaves Commerce Court after Nine Years
Effective April 12, 2021, Judge Leon Tucker joined the Commerce Court bench, and Judge Nina Wright Padilla replaced Judge Glazer as Commerce Court Supervising Judge.
Judge Glazer was elected to Philadelphia’s Court of Common Pleas in 1991, and was assigned to the Commerce Court effective May 1, 2012. He became the Commerce Court’s Supervising Judge in 2018, after then Supervising Judge Patricia McInerney’s retirement. He has carried considerable administrative and leadership responsibilities within the Commerce Program and Court-wide. Before joining the bench, Judge Glazer served as an Assistant United States Attorney in Philadelphia where, among other things, he investigated and prosecuted judicial corruption in the Philadelphia Court System in the late 1980s.
